The North Carolina crime lab has been experiencing problems with processing DWI blood tests due to the quantity that have been brought to
the lab. The North Carolina legislature is attempting to pass a bill which would allow the hospital that takes the blood sample, to also test for BAC in the sample.
One such bill has recently been presented in the NC House of Representatives that would permit a hospital, who has a chemical analyst on staff to test the BAC of a sample. Further, if the person being charged with DWI does not submit a written objection within a certain time frame, the report from the hospital can be admitted into evidence without testimony from the analyst. This particular bill must pass a vote in the Senate, and is ready to go in front of them this month.
Therefore, with the shifting laws in the state, it is important to have an attorney that knows how to navigate through the various idiosyncrasies.
